General:
1. Calabria4u.com are a web based advertising medium for the means for you to be able to rent your property and/or for you to be able to rent a property.
2. Calabria4u.com are not an estate agent nor are we a lettings agent.
3. Calabri4u.com do not propose to own nor do they own any home/home's that are advertised on our site, furthermore Calabria4u.com act purely as an advertisement tool and nothing more. Services offered in any advert are provided by a third party and not ourselves.
4. These terms and conditions constitute part of a legal agreement and as such you agree that any contract and or rental taken or supplied shall be bound by them and you (Rental client/Home owner) agree to them in full and also that you have read and understood them.
Home owners:
1. Calabria4u.com will only advertise your property and any services needed outside of advertising shall be provided, if required, via a third party.
2. Any income or associated taxes, be they local or international, that you generate via this site and or its enquiry for bookings with regards to your property will be your responsibility and yours alone.
3. We will only pass on inquiry details to your personal home address or Email address. If required a personal "Calabria4u.com" email address service can be arranged for you.
4. We will not collect nor hold rental income on your behalf unless written consent is given prior.
5. All rental income will be passed direct to yourself by mutual arrangement with whomever rents your property.
6. Any monies paid to ourselves reflect the design and implementation of advertising of your property and the use of our medium to advertise said property along with, if required, a key holding service only.
7. We will not, nor are we liable to take commission nor shall we charge you a percentage of any income that you receive through advertising your property via our advertising medium.
8. Calabria4u.com are in no way liable for any damage to your property nor any loss of income you may encounter nor are we liable to provide you with nor implicate any form of insurance. This is entirely your responsibility.
9. It is the homeowner's responsibility to inform Calabri4u.com of any bookings received outside of this website. That is, if said bookings are from another source. We do require and its part of our terms and conditions, that should you advertise your property else where, be that Internet based or otherwise, we are informed of the existence of any advert and also we ask that all "contact us/owner" details should all be directed thru ourselves via our emails address. Calabria4u.com will not be liable for double bookings we also hold the right to terminate any advert and or contract without warning if this condition is not adhered too. If we fail to receive information regarding an outside '3rd party' booking and should a case where a "double booking/client arrival" arises (be that part or full week booking), you the home owner shall be liable for all costs to the third party.
9. Where a BID (Breakages, Inventory Deposit) is requested then this will serve as part/full payment for any damage proved to be done by the rental client. In all cases where damage has occurred (within reason) by the rental client this BID will be deemed as non refundable to the rental client.
10. Please be advised that we are not able to guarantee nor do we guarantee that your property will rent in any given period.
Contract termination:
We hold the right to terminate any contract with us, without warning, at any time. In all cases, for whatever reason, if we terminate a contract, all keys will returned to the property owner as soon as is reasonably practicable and any moneis paid to us and or outstanding by us will be forfit. Out of contract charges will apply within 24hours of cancellation of your contract with us. See bellow.
In cases of Pre-term termination (from either party) of our contracts, we will only handover keys at the property that they belong to and that is stated on the contract that has been signed and or return the keys via post, to an address supplied by you and or that is on our/your contract
No other place of business or property will suffice.
Being that either we or you have terminated our agreement, then, this means we are "Out of contract" and therefore, there will be a charge (See "Out of contract" charges") to attend on the day of handover or to post said keys to cover our costs/time. Attendance cost stands at our normal daily charge of 100 Euro with "Out of contract" key holding charged at 10 Euros a day after the first 24hrs of notification. This charge is payable prior to release and said funds being clear. There are no exceptions to the above.
Contract/ Works Payments:
Any and all payments made to us with regards to Advertising, Rental contracts, Key holding contracts and or any contract works (be they verbal or written) that you request us to undertake are Non refundable for what so ever reason, no matter how so ever caused. Once any payment is made, we will endeavor to fulfill our contractual obligations as expected by you the client. We do not however Guarantee that any and all works and or contracts will be meet due to any instance outside our control these include but not limited too, act of war, natural disaster including, floods, earthquakes, landslides and or any other act of God. Contract supplier failure, bankruptcy, insolvency and or any other demur-rage unforeseen. In any case that the company “Calabria4u” and or its affiliates becomes insolvent and or bankrupt, no refunds whole or in part will be given or are indeed implied.
In all cases whether they be contract based or 'Adhoc' we do not accept cheques and will only accept payment for any services rendered via BACS transfer and or Cash. Prior to any works being carried out, we will require 50% payment and or full payment upfront. This is to paid, via cleard funds, prior to any works being undertaken *Unless it is during the tenure of a signed 'Rental/Key holding contract' and work is carried out at your request, in this case, a invoice will raised and sent and payment terms are 14 days from invoice dispatch.
Rental clients:
1. If you rent a property via this website and you find that the property is not as described or has a fault, then any regress or complaint you have should be passed direct to the owner, all reasonable and practical measures are taken to ensure that any property that’s advertised on our website is of clean, habitable and sound condition, furthermore we will (where practical or possible) check the property is, as it is going to be advertised. We do not nor can we guarantee that any service or description of a property is correct and where found to be misleading then you will need to contact the owner for any recourse.
2. Cleaning and linen services that are offered in any advert are/will be liable to be paid by yourselves locally (before you receive the keys) to whomever is charged for cleaning the property you rent or whomever or whatever agent delivers your keys. You will be given a receipt by the cleaner or agent, if you so require one.
3. When required and you are met to be handed the keys, an inventory check list may be required to be signed and again, if required, a BID (Breakages, Inventory Deposit) will be collected to the amount specified in the advert. This BID will be returned to you, subject to a satisfactory inventory being taken, upon collection of the keys for the property at the end of your stay or shall be returned within 28days via BACS if paid at the time of booking.
4. Where a BID (Breakages, Inventory Deposit) is requested then this will serve as part/full payment for any damage by you the rental client that may be caused. In all cases where damage has occurred by you the rental client, this BID will be deemed as non refundable no matter how much damage has been or is caused within reason, ie, a broken plate would not negate a retention of BID whereas a broken TV or window would, with any shortfall of or extra expenditure to be paid by yourself.
Payments:
Payments made for properties by yourself shall be made to the owner direct via BACS transfer. All bookings will require a deposit of 30% for the rental period. If a booking is made within 30 days of arrival then the full rental amount shall be due. Any and all monies whether deposit and or full holiday cost are deemed as full and final payment and no refunds, part or whole, shall be given or implied for whatsoever reason.
Cancellations:
Cancellation refunds will not be given (in full or part) for whatever reason if a cancellation is made, these serve as dispensation to the home owner for loss of income for the given booking.
Date changes or late arrivals:
We shall do our best to accommodate any such changes and as long as reasonable notice is given, subject to the apartment that you have booked being free for the dates requested for change, However,any date changes or late arrivals due to circumstances outside our control or due to you (the rental client) changing the dates required that you have confirmed for accommodation shall result in forfeiture of any and all monies paid to the home owner and neither we (Calabria4u) or the home owner we advertise on behalf of, shall not be liable to give a refund in either full or part payment for whatever reason. This is to cover our and our clients costs of possible loss of earnings and also to save disappointment/disruption to the preceding/following client. No exception shall be made to this rule for whatever reason.
Dispute/complaints:
Should you have a dispute/complaint against either ourselves or any service offered or supplied you should in the first instance contact us stating (in writing) your discrepancy/complaint, we in turn, shall deal with your complaint in a fair manor, should this outcome still not be to your satisfaction then you may contact our directors who will look into your complaint and respond accordingly and in person. The directors decision shall be final.
Out of contract charges.
The following only apply to non contract clients and do not constitute part of any rental or key holding contract that may be in force with any client whatsoever.
Attendance/Call out:
Any attendance shall be charged at 100 Euro per visit plus 20 per hour after the first 15 mins
Key handover:
Cancellation of contract key handover (Return to owner or New key holder) 100 Euro
Plus mileage @ 1.75 Euro per km. (Estimation mlg used for charging. Based on “Route planner”)
Keys only handed over with prior written consent/instruction and only after any charges and or invoice are settled/clear with us.
Key holding charges:
Holding fee 50 Euro then charged at 10 Euros per week there after.
Demur-rage/Rolling: Charged at 60 Euro for the first hour then at 20 Euro per hour therein after until conclusion of Business.
Communication charges:
Hand written letters: 25 Euro per letter.
Email correspondence @ 10 Euro.
Phone calls, received: 0 Euro.
Phone calls made: 2 Euro per minute.
Outstanding invoice charges:
All the following will include communication charges as above for each reminder sent.
1st Month 5% of outstanding debt/invoice.
2nd Month 10% of outstanding debt/invoice.
3rd Month 20% of outstanding debt/invoice.
4th Month 30% of outstanding debt/invoice.
5th Month 40% of outstanding debt/invoice. Final warning before commencement of proceedings
6th Month 50% along with referral to debt collection agent for recovery and or repossession of goods.
